Terms of Service

1. Acceptance of Terms

Welcome to Muay Thai AI. By accessing or using our mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Muay Thai AI ("we," "our," or "us"). We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Description of Service

Muay Thai AI is an AI-powered coaching platform that provides:

• Video Analysis: AI-powered analysis of your Muay Thai training videos
• Personalized Feedback: Technique corrections and coaching advice generated by artificial intelligence
• Progress Tracking: Gamified progression system with experience points, fighter statistics, and drill completion tracking
• Training Programs: Structured drill progressions across multiple Muay Thai fighting styles
• Reference Library: Educational content and demonstration videos

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account using either Google Sign-In or Apple Sign-In. By creating an account, you represent that:

• You are at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
• If you are under 18, you have obtained parental or guardian consent to use the Service
• The information you provide is accurate and complete
• You will maintain the security of your account credentials

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to:

• Maintain the confidentiality of your authentication credentials
• Notify us immediately of any unauthorized access to your account
• Not share your account with others or allow others to access the Service through your account

4. Subscription and Payment

4.1 Free Tier

The Service offers a free tier that includes a limited number of video analyses. Once you have used your free analyses, you will need to subscribe to continue using the analysis features.

4.2 Pro Subscription

The Pro subscription provides unlimited access to video analysis features. Subscription options include:

• Monthly Subscription: Billed monthly on a recurring basis
• Annual Subscription: Billed annually on a recurring basis

4.3 Payment Processing

All payments are processed through the Apple App Store. By subscribing, you agree to:

• Apple's terms and conditions for in-app purchases
• Automatic renewal of your subscription unless cancelled at least 24 hours before the end of the current period
• Management of subscriptions through your Apple ID account settings

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. Refund requests must be directed to Apple in accordance with their refund policies.

4.5 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle after the change.

5. User Content

5.1 Video Uploads

When you submit videos for analysis ("User Content"), you grant us a limited, non-exclusive license to:

• Process and analyze your videos using AI technology
• Extract frames for the purpose of technique analysis
• Store analysis results and feedback associated with your account
• Use anonymized, aggregated data to improve our AI models

5.2 Content Ownership

You retain all ownership rights to your User Content. We do not claim ownership of your videos or training footage.

5.3 Content Requirements

You represent and warrant that your User Content:

• Does not infringe on any third party's intellectual property or privacy rights
• Does not contain illegal, harmful, or objectionable material
• Features only you or individuals who have consented to being recorded
• Is related to Muay Thai or martial arts training

5.4 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that is violent, threatening, harassing, defamatory, or obscene
• Attempt to circumvent the video analysis limits or subscription requirements
• Submit duplicate videos to manipulate the progression system
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Share, resell, or redistribute access to the Service
• Use the Service to train competing AI models without our written consent

7. AI Analysis Disclaimer

7.1 Nature of AI Feedback

The feedback provided by our AI coaching system is generated by artificial intelligence and is intended for educational and informational purposes only. You acknowledge and understand that:

• AI-generated feedback is not a substitute for instruction from a qualified human coach or trainer
• AI analysis may not be 100% accurate and may contain errors or omissions
• The Service cannot assess all aspects of technique, including factors not visible in video
• AI feedback should be used as a supplementary training tool, not as sole guidance

7.2 No Professional Advice

The Service does not provide medical, fitness, or professional athletic advice. Before beginning any training program or making changes to your technique:

• Consult with a qualified Muay Thai instructor or coach
• Consult with a healthcare professional if you have any health concerns
• Understand your own physical limitations and train accordingly

7.3 Assumption of Risk

Martial arts training involves inherent risks of injury. By using the Service, you acknowledge that:

• You participate in training at your own risk
• We are not responsible for any injuries that may result from following AI-generated feedback
• You should warm up properly and train in a safe environment
• You should stop training immediately if you experience pain or discomfort

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its design, features, content, AI models, training programs, and branding, is owned by Muay Thai AI and protected by intellectual property laws. You may not:

• Copy, modify, or distribute any part of the Service
• Use our trademarks, logos, or branding without permission
• Create derivative works based on the Service
• Use the Service content to train AI models

8.2 Feedback

If you provide suggestions, feedback, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution.

9. Third-Party Services

The Service integrates with third-party services including:

• OpenAI and Google for AI processing
• Apple for authentication and payments
• Google for authentication
• Analytics and error tracking services

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimers

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• AI analysis will be accurate, complete, or reliable
• The Service will meet your specific requirements or expectations
• Using the Service will improve your Muay Thai skills or performance
• Any defects or errors will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MUAY THAI AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to your account
• Any damages resulting from errors, mistakes, or inaccuracies in AI feedback
• Any personal injury or property damage related to your use of the Service

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED FIFTY DOLLARS (US $50.00). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless Muay Thai AI and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights
• Any injury to yourself or others resulting from your training activities

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us or through the app settings. Upon termination, your right to use the Service will immediately cease.

13.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms.

13.3 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• Your subscription will not be automatically refunded (contact Apple for refund requests)
• We may delete your account data in accordance with our Privacy Policy
• Provisions of these Terms that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will remain in effect

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days.

14.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except for disputes that qualify for small claims court. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association.

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the federal or state courts located in California.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Muay Thai AI regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting a notice within the app
• Sending an email to the address associated with your account
• Updating the "Last Updated" date at the top of these Terms

Your continued use of the Service after any changes indicates your acceptance of the modified Terms.
