1. Acceptance of Terms

Welcome to Muay Thai AI. By accessing or using our mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Muay Thai AI ("we," "our," or "us"). We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Description of Service

Muay Thai AI is an AI-powered coaching platform that provides:

• Video Analysis: AI-powered analysis of your Muay Thai training videos
• Personalized Feedback: Technique corrections and coaching advice generated by artificial intelligence
• Progress Tracking: Gamified progression system with experience points, fighter statistics, and drill completion tracking
• Training Programs: Structured drill progressions across multiple Muay Thai fighting styles
• Reference Library: Educational content and demonstration videos
• Community & Social Features: Weekly challenges and leaderboards, community submission feeds, and "Beat a Friend" head-to-head challenges that let you share training videos, scores, and your username with other users

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account using either Google Sign-In or Apple Sign-In. By creating an account, you represent that:

• You are at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
• If you are under 18, you have obtained parental or guardian consent to use the Service
• The information you provide is accurate and complete
• You will maintain the security of your account credentials

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to:

• Maintain the confidentiality of your authentication credentials
• Notify us immediately of any unauthorized access to your account
• Not share your account with others or allow others to access the Service through your account

4. Subscription and Payment

4.1 Free Tier

The Service offers a free tier that includes a limited number of video analyses. Once you have used your free analyses, you will need to subscribe to continue using the analysis features.

4.2 Pro Subscription

The Pro subscription provides unlimited access to video analysis features. Subscription options include:

• Monthly Subscription: Billed monthly on a recurring basis
• Annual Subscription: Billed annually on a recurring basis

4.3 Payment Processing

All payments are processed through the Apple App Store. By subscribing, you agree to:

• Apple's terms and conditions for in-app purchases
• Automatic renewal of your subscription unless cancelled at least 24 hours before the end of the current period
• Management of subscriptions through your Apple ID account settings

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. Refund requests must be directed to Apple in accordance with their refund policies.

4.5 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle after the change.

5. User Content

5.1 Video Uploads

When you submit videos or other materials ("User Content"), you grant us a limited, non-exclusive, royalty-free, worldwide license to:

• Process and analyze your videos using AI technology
• Extract frames for the purpose of technique analysis
• Store analysis results and feedback associated with your account
• Use anonymized, aggregated data to improve our AI models
• Where you choose to submit User Content to community, leaderboard, Weekly Submissions, or "Beat a Friend" features, host, store, copy, reproduce, and display that content — together with your username and score — to other users of the Service for the purpose of operating those features

5.2 Content Ownership

You retain all ownership rights to your User Content. We do not claim ownership of your videos or training footage.

5.3 Content Requirements

You represent and warrant that your User Content:

• Does not infringe on any third party's intellectual property or privacy rights
• Does not contain illegal, harmful, or objectionable material
• Features only you or individuals who have consented to being recorded
• Is related to Muay Thai or martial arts training

5.4 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

5.5 Community and Shared Content

Some features let you share content with other users — including Weekly Challenges and leaderboards, community submission feeds, and "Beat a Friend" head-to-head challenges. When you use these features, you acknowledge and agree that:

• Content you submit is not private and will be visible to other users of the Service, along with your username and score.
• You are solely responsible for what you choose to share, and you should not share anything you are not comfortable being viewed or captured by others.
• You grant other users the ability to view your shared content within the Service.
• Although we do not provide any tool to download or repost another user's content, we cannot prevent other users or third parties from screen-recording, screenshotting, or otherwise capturing content shown to them and sharing it outside the Service, including on social media or other platforms. You assume this risk when you share content.
• We are not responsible or liable for how any user or third party uses, copies, redistributes, or misuses content once it has been shared or displayed.
• You may remove your shared content at any time using the in-app controls. Removal stops future display within the Service but cannot retrieve copies that others may have already captured.

5.6 Other Users' Content

Content shared by other users belongs to them. You agree that you will not download, screen-record, screenshot, copy, reproduce, publicly display, or redistribute another user's content, whether inside or outside the Service, without that user's express permission. Violations may result in suspension or termination of your account and may expose you to liability to the affected user.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that is violent, threatening, harassing, defamatory, or obscene
• Attempt to circumvent the video analysis limits or subscription requirements
• Submit duplicate videos to manipulate the progression system
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Share, resell, or redistribute access to the Service
• Download, screen-record, screenshot, copy, or redistribute another user's content without their express permission
• Upload or share content depicting any person who has not consented to being recorded and shared
• Harass, threaten, stalk, or abuse other users through community or challenge features
• Use the Service to train competing AI models without our written consent

7. AI Analysis Disclaimer

7.1 Nature of AI Feedback

The feedback provided by our AI coaching system is generated by artificial intelligence and is intended for educational and informational purposes only. You acknowledge and understand that:

• AI-generated feedback is not a substitute for instruction from a qualified human coach or trainer
• AI analysis may not be 100% accurate and may contain errors or omissions
• The Service cannot assess all aspects of technique, including factors not visible in video
• AI feedback should be used as a supplementary training tool, not as sole guidance

7.2 No Professional Advice

The Service does not provide medical, fitness, or professional athletic advice. Before beginning any training program or making changes to your technique:

• Consult with a qualified Muay Thai instructor or coach
• Consult with a healthcare professional if you have any health concerns
• Understand your own physical limitations and train accordingly

7.3 Assumption of Risk

Martial arts training involves inherent risks of injury. By using the Service, you acknowledge that:

• You participate in training at your own risk
• We are not responsible for any injuries that may result from following AI-generated feedback
• You should warm up properly and train in a safe environment
• You should stop training immediately if you experience pain or discomfort

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its design, features, content, AI models, training programs, and branding, is owned by Muay Thai AI and protected by intellectual property laws. You may not:

• Copy, modify, or distribute any part of the Service
• Use our trademarks, logos, or branding without permission
• Create derivative works based on the Service
• Use the Service content to train AI models

8.2 Feedback

If you provide suggestions, feedback, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution.

8.3 Copyright and Content Complaints

We respect intellectual property and privacy rights and expect users to do the same. If you believe content on the Service infringes your copyright or other rights, or depicts you or was shared without your consent, please contact us at contact@muaythai-ai.com with a description of the content, its location within the Service, and your contact information. We will review and, where appropriate, remove the content promptly. We may also remove content and suspend or terminate the accounts of users who repeatedly infringe the rights of others.

9. Third-Party Services

The Service integrates with third-party services including:

• OpenAI and Google for AI processing
• Apple for authentication and payments
• Google for authentication
• Analytics and error tracking services

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimers

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• AI analysis will be accurate, complete, or reliable
• The Service will meet your specific requirements or expectations
• Using the Service will improve your Muay Thai skills or performance
• Any defects or errors will be corrected

10.3 User Content and Third-Party Redistribution

The Service may display content submitted by other users. We do not endorse, verify, or assume responsibility for any user content. We are not responsible for the conduct of any user, or for any content that users share, capture, or redistribute — including content that is screen-recorded, screenshotted, or reposted on social media or other platforms outside the Service. Your interactions and disputes with other users are solely between you and those users, and you release Muay Thai AI from any claims, demands, and damages arising out of such interactions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MUAY THAI AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to your account
• Any damages resulting from errors, mistakes, or inaccuracies in AI feedback
• Any personal injury or property damage related to your use of the Service

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED FIFTY DOLLARS (US $50.00). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless Muay Thai AI and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Content you share through community or social features, and any capture, copying, or redistribution of that content by you or others
• Your violation of any third-party rights
• Any dispute between you and another user
• Any injury to yourself or others resulting from your training activities

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us or through the app settings. Upon termination, your right to use the Service will immediately cease.

13.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms.

13.3 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• Your subscription will not be automatically refunded (contact Apple for refund requests)
• We may delete your account data in accordance with our Privacy Policy
• Provisions of these Terms that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will remain in effect

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days.

14.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except for disputes that qualify for small claims court. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association.

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the federal or state courts located in California.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Muay Thai AI regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting a notice within the app
• Sending an email to the address associated with your account
• Updating the "Last Updated" date at the top of these Terms

Your continued use of the Service after any changes indicates your acceptance of the modified Terms.

18. Apple App Store — Additional Terms

The following applies where you obtained the app through the Apple App Store. These terms are required by Apple and are in addition to, and do not limit, the rest of these Terms.

18.1 This Agreement Is With Us, Not Apple

These Terms are between you and Muay Thai AI only, and not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content. Your licence to use the app is a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.

18.2 Maintenance and Support

We are solely responsible for providing any maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services in relation to the app.

18.3 Warranties

Apple gives no warranty in relation to the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you (where one was paid). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever in relation to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.

18.4 Claims

We, not Apple, are responsible for addressing any claims relating to the app or your possession and use of it, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection or similar legislation, and claims that the app infringes a third party's intellectual property rights.

18.5 Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

18.6 Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this Section 18, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Section 18 against you as a third-party beneficiary of these Terms.
